End User License Agreement

License Grant

We grant you a personal, non-exclusive, non-transferable license to install and use the Product on your own devices. The Product is designed exclusively for Microsoft Flight Simulator 2024 and is not intended for use with earlier versions or other simulators. You may make backup copies for personal use.

Restrictions

You may not:

• Sell, rent, lease, redistribute, or sublicense the Product.

• Share the Product with anyone outside your household.

• Reverse-engineer, decompile, or extract any code, models, or assets.

• Use the Product for real-world aviation training or any purpose outside the simulator.

Community Content

You may create and share screenshots, videos, reviews, and tutorials using the Product, and you may upload such content to platforms like YouTube, Discord, or the Microsoft Flight Simulator forums. You may monetize this content (for example, through ads or streaming) provided that you do not redistribute the Product itself.

Custom Liveries

We may provide a paintkit or livery template file. You may create, share, and sell liveries based on this template, subject to these conditions:

• The livery must not include or redistribute the Product.

• It must clearly state that it is for use with a FlightSimGames aircraft model.

• You are responsible for ensuring your livery complies with applicable laws.

  No other modifications are permitted without our written consent.

Ownership

All intellectual property rights in the Product remain with FlightSimGames. This license does not transfer ownership.

Disclaimers and Limitations of Liability

Nothing in this EULA will prejudice the statutory rights you may have as a consumer under applicable law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability; in such cases, these disclaimers and limitations apply only to the extent permitted.

Disclaimer of Warranties

The Product (aircraft add-on) is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of title, non‑infringement, merchantability, or fitness for a particular purpose. We do not warrant that:

• The Product will be error-free, uninterrupted, or compatible with all hardware/software environments.

• The Product will remain compatible with Microsoft Flight Simulator following future updates.

• Any issues will be corrected within a specific timeframe.

We make no assurances that the Product will be compatible with any software other than Microsoft Flight Simulator 2024. We are not responsible for simulator updates, third-party software conflicts, or hardware issues. Refunds, if applicable, are provided only by the third-party platform (e.g., simMarket).

Limitation of Liability

To the fullest extent permitted by law, FlightSimGames shall not be liable for indirect, incidental, or consequential damages of any kind, including but not limited to lost profits, goodwill, or data, arising from the use or inability to use the Product. Refunds, if any, are subject to the policies of the third‑party platform where the Product was purchased (e.g., simMarket).

Force Majeure

We are not responsible for delays or failures to perform resulting from causes beyond our reasonable control. This includes, without limitation, war, terrorism, natural disasters, strikes, labor shortages, energy outages, or outages and changes in third‑party platforms such as Microsoft Flight Simulator or simMarket.

Indemnification

You agree to indemnify and hold harmless FlightSimGames, its affiliates, and staff from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from: (i) your misuse of the Product, (ii) your violation of this EULA, or (iii) your breach of obligations, representations, or warranties under this EULA. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with us in defending such claims.

Termination

We may terminate your license immediately if you breach this EULA, including by reselling, redistributing, or misusing the Product. Upon termination, you must delete all copies of the Product. We reserve the right to refuse future licenses to users who breach this EULA.

Governing Law

This EULA is governed by general principles of international contract law. Local consumer protection laws may apply in addition to these terms.
